Abstract

Introduction to educational rights in the Spanish Constitution Within the legal framework governed by the Spanish Constitution of 1978, each party in the government has implanted its own educational law. More than consensus laws, they are party laws. These educational laws can have only the contents that fit in the limits of the constitutional regulation. These limits are identified, in essence, with the different educational rights embodied in the Constitution, which are summarized in the next two rights : the right to education, as a social right that guarantees the effectiveness of access to knowledge; and the right to general freedom of education, as the right to freedom that assures freedom in the transmission of instruction, which is specified, in turn, in four particular educational freedoms: freedom of professorship, freedom of foundation of educational centers, the right of parents so that their children receive religious and moral education that is in accordance with their own convictions and with university autonomy.
