Zusammenfassung
Disciplinary dismissal of a worker with reduced working hours to care for a child. The evidentiary ineffectiveness of the search of the bag carried out in violation of article 18 of the ET would have led to the classification of the dismissal as unfair. However, since this is a worker with reduced working hours to care for a minor child, the dismissal should be declared automatically null and void by application of article 55.5.b) of the ET.
