Abstract

Termination of the employment contract due to absolute permanent incapacity (IPA) ex article 49.1.g) of the ET, with the particularity that the employer, once declared to be in a situation of IPA, did not cease her activity or close the business immediately. The question is to determine what is to be understood by a reasonable or prudential period between the employer's declaration of PI and the termination of the employment contracts.
