Abstract

We dedicate this commentary to the Supreme Court’s analysis of the principle of proce-dural consistency, in the process of a court decision recognising the additional 20% supplement to the “qualified” total permanent disability benefit, even though it was not expressly requested, neither in administrative processing nor in the legal proceeding. The adopted solution by the High Court in its judgement No. 132/2020 makes the aforementioned congruence more flexible in order to admit, first and foremost, that something is expressly “not requested” (nor excepted), overcoming formal rigidities, which should not preface the coverage of the situation of need, where the material requirements for the recognition of the right are met and the service manager is not helpless.
