Abstract

Without questioning the legislator’s wisdom in recognising de facto guardianship as a support measure, the facts have been stubborn in demonstrating that its incorporation into the legal system was not going to be free of difficulties, in particular, with regard to the guardian’s intervention in the exercise of representative powers before financial institutions. In an attempt to solve the problems raised, the Interpretative Document on the de facto guardianship in Law 8/2021, signed by the Fiscalía General del Estado and the banking associations, was published, to the study of which we will devote the following pages.
