Abstract

This doctoral thesis addresses two very different parts of the problem of sexual abuse towards minors by clerics in Spain. Before diving into this issue, the author introduces us to the complex reality of sexual abuse of minors in terms of history, sociology, and psychology. In the first part of the investigation, he analyzes the criminal and procedural laws of canon law to prosecute these crimes. The author, then, in the second section, studies the international legal cooperation in criminal matters of the Spanish State, and the Catholic Church, through the Holy See and the Vatican City State. Finally, the author analyzes the problems of procedural cooperation between the state and canonical legal systems when prosecuting these heinous crimes, and offers novel solutions so that there is broad and reciprocal cooperation between both legal systems.
