Abstract

The Spanish Law on Assisted Human Reproduction Techniques, No. 14/2006 (May 26, 2006), accepts the performance of a preimplantation genetic diagnosis (PGD) when it comes to avoiding a serious genetic disease, of early appearance and without current postnatal healing, apart of the cases with favorable report of the National Commission of Assisted Human Reproduction (CNRHA). However, these concepts have not been defined. This has led to differences in the interpretation of the Law by clinics and units of assisted human reproduction (URHA) that practice the test, affecting the possibilities of people to access a PGD. The definition of these criteria seems essential to guarantee the principle of justice, although it is also possible to create a list of susceptible diseases by CNRHA, a legal duty that has not yet been carried out.
