El procedimiento judicial para la impugnación de la aportación al Tesoro Público derivada de los despidos colectivos que afectan a personas trabajadoras maduras

Abstract

Law 36/2011, October 10th, regulation of social jurisdiction, has extended the objective uses for Tribunals and Courts of the social order including several procedures that formerly took place in the administrave order. Within these new claims, it is include the lawsuit against the liquidation for the Public Treasury that companies have to assume when they apply for a collective dismissal, that speccially affects employees of fifty or more years of age. Both the legal regulation of the contribution its procedure show many particularities. Therefore, in some occasions, the practical implementation is bringing more tan a few queries to solve. All this in mind, this report aims to focus on the study of the specifics of this procedure which is ruled by the labor jurisdiction regulation in its articles 151 and 152.
