Problemática de la responsabilidad penal en los derechos de explotación económica del autor: el caso «Seriesyonkis»

Resum

Violation of copyrights, especially those of economic exploitation, are still relevant today, deserving of punishment by both via civil and criminal. In this regard, in recent years we have witnessed several reforms of our regulations in this matter, being evident its gradual aggravation; as reflection of this it we have to emphasise the changing position shown in the case-law so far. From the criminal perspective, the current situation of its legal regulation and the position of the Spanish Fiscalía General del Estado (Spanish Public Prosecutor national office), are worthy of attention; mostly after the recent judgement on the «Seriesyonkis» case, which brings important novelties on the topic.
