La " influencia negativa" del progenitor y custodiareflexiones acerca de la jurisprudencia reciente

Abstract

Breakups between couples with children in common usually involve disputes about how parent-child relationships are going to be managed, mainly with regard to custody, but they get aggravated when one of the parents aims to confront the minor child against the other. Some attempt has also been made to integrate this negative influence into the controversial «parental alienation syndrome», though it has not been supported by the scientific-technical authorities. In this regard. On this point, the courts and tribunal’s position has been diverse regarding its recognition and acceptance as a cause of minor children custodial arrangements’ modification, but the most recent jurisprudence of the Supreme Court seems to indicate a change of course, although it focuses in the harmful behaviour circumventing the polemic debate of the above mentioned syndrome.
