Résumé
This work faces the problematic topic of the moral damages reparation derived from author rights» violation, issue that has been source of controversy in Spain until recently, due to the obscure redaction of the precept that regulates it in our Intellectual Property Law, after the reform introduced in 2006. The interpretative troubles arisen have required the Courts of justice’s intervention, both in the communitarian-european level and the Spanish national one, setting an interesting doctrine in this regard
