Résumé

Spain, which has always struggled to fully guarantee the rights of citízen participation in environmental matters has been the subject of an adverse decision of the Compliance Committee of the Aarhus Convention in íts decision of December 18th, 2009. The case, which involves issues concerning the urban planning of the Autonomous Community of Murcia, high!;ghts the failures of the Spanish legislation on public participation and government neglect in this connection. The final conclusions adopted by the Compliance Commitree of the Aarhus Convention on December 18th. 2009, althoug/1 relatívely modest in scope, do not fail to report several violations of the Conventíon by the Party concemed. The Committee 's findings also add specific recommendatíons to rectify the situation.
