Résumé
The decision to terminate a civil servant's employment due to incapacity for work does not have to specify the degree of incapacity. The Medical Tribunal deeming an employee to be totally unable to carry out service-related duties, but not any profession or trade, will have, if necessary, consequences for determining the civil servant's rights but not the declaration of retirement, for which it is only necessary to be totally unable to carry out the functions of their Corps or Rank. Only expert evidence that meets the requirements set out in civil procedural legislation can undermine the presumption of correctness of the official assessment of ailments.
