La función inspectora en competencia desde las últimas resoluciones administrativas y/o judiciales

Abstract

The article studies the inspection function of competition authorities from a practical point of view. With this objective, we examine some of the issues that have been discussed by courts and competition authorities (Spanish and from the European Union) and which are directly related to the inspection activity. Among them, reference is made to the limits (subjective and objective) of the inspection, its motivation and the legal assistance to inspected undertakings, all based on recent judicial and/or administrative decisions. The main purpose of this study is to assess the level of legal certainty derived from practice in relation to the legal position of those inspected by competition authorities.
