Abstract

The Data Protection Officer is a key figure in the implementation, guidance, advisory, and compliance with the GDPR and the LOPDGDD. This role was created to maintain close collaboration between supervisory authorities and the data controllers and processors, cooperating with the former, advising, and ensuring GDPR compliance with the latter. Therefore, it is not common for the Data Protection Officer to be one of the affected parties by unlawful processing carried out by the data controller and to become involved in a potential conflict of interest.
