Abstract
The regulation of teleworking and its presence in collective bargaining has followed an uneven trajectory in Spain and Italy. However, in 2020, a paradigm shift occurred with the spread of Covid-19 and the urgency of social isolation measures. To deal with its effects, the urgent need arose to consolidate and provide regulatory content to remote work. In both countries, this new scenario has brought with it different ways of filling the regulatory vacuum from the negotiating tables, which has even generated controversies that have had to be resolved in court. This paper analyzes the recent evolution of the role of collective bargaining in the regulation of teleworking in a comparative way in the Spanish and Italian labor relations frameworks, as well as the role that the group of teleworkers can play in future collective agreements.
